The year 2026 brings an extremely tough survival test for Romanian entrepreneurs. Increasing fiscal pressures, declining consumption, and market instability are pushing thousands of businesses towards the brink. In the face of this imminent collapse, commercial courts have become veritable emergency rooms for the national economy. Here, the insolvency judge faces a monumental and highly responsible task daily. The magistrate must make the vital distinction between mere temporary financial difficulty and irreversible structural degradation of the company in question.

The situation on the ground is extremely difficult. Official data provided by the Trade Register, analyzed by Sierra Quadrant, show a massive deterioration of the business environment since the early months of this year.
After a 2025 in which over 7,500 companies became insolvent, the beginning of 2026 has significantly accelerated this decline.

In January and February alone, nearly 1,100 new insolvencies were recorded, marking an increase of over 13 percent compared to the same period last year.

Furthermore, voluntary company dissolutions have actually exploded. Over 5,400 firms permanently closed their doors in January alone, a staggering increase of 47 percent.

The sectors most heavily impacted are trade, construction, and manufacturing. In this deeply stifling economic context, more and more entrepreneurs are finding themselves in court, desperately seeking protection from creditors. This is where the judge's expertise comes into play, as they are the only ones who can decide whether the business is still legally worth a chance at reorganization or must be urgently liquidated.

What is the real boundary between a moment of blockage and a total collapse?

The answer to this question immediately determines the fate of hundreds of employees, creditors, and founders.
According to experts at Sierra Quadrant, a temporary difficulty arises when a commercially viable company suddenly faces an acute liquidity crisis. This could be due to a major client delaying a vital payment or an unforeseen fiscal shock appearing overnight.

The company still has a clear market, generates added value, but has temporarily run out of cash. In these cases, rapid prevention and restructuring procedures are absolutely essential to save the business.

On the other hand, structural degradation represents a terminal stage for an economic entity. We are talking about companies that have been operating strictly at a loss for years.

Their business model is completely technologically or commercially obsolete, their debts are toxic and far exceed the value of all their assets, and the market simply no longer needs their products. In this case, artificially keeping the company alive only causes further major damage to the economy, by accumulating new non-performing debts to the state and to bona fide suppliers.

The crucial role of the insolvency judge in saving the economy

The magistrate not only reviews a file full of cold accounting figures, but also assesses the real pulse of a business and its future potential. The judge must quickly and accurately identify the debtor's true intentions.

„Unfortunately, practice shows that many administrators use insolvency proceedings in bad faith, solely to block enforcement actions and artificially delay proceedings. A superficial analysis by the court can allow a bankrupt company to destroy, through a domino effect, other completely healthy business partners.”, states Ovidiu Neacșu, coordinating partner at Sierra Quadrant in an analysis published on his personal blog.

To correctly draw this fine line, the decision-maker relies on detailed reports from judicial administrators, economic expertise, and knowledge of market dynamics.

Its decision to approve a reorganization plan or declare bankruptcy directly must be purely surgical.

„Prudence is legitimate. However, if every situation is implicitly viewed through the lens of irreversibility, prevention tools risk remaining peripheral, not to mention useless. Furthermore, a vicious cycle emerges where, when prevention is rarely used, insufficient successful jurisprudence is created. Entrepreneurs become reluctant, lawyers hesitate to recommend, and practitioners invest less in ambitious recovery plans.”adds Ovidiu Neacșu.

Saving a viable company protects jobs and maintains local economic stability. In contrast, the rapid and clean bankruptcy of a failing firm cleans up the competitive market and allows for the redistribution of financial and human resources to truly performing businesses.

What's next for the private sector in the coming months

Prospects for the second half of 2026 remain fraught with huge challenges for the private sector. Recent legislative changes and increasing lending costs will force an extremely tough natural selection in the economy.

„High inflation will remain the biggest problem in the economy in the coming months. Unfortunately, this phenomenon will lead to an exacerbation of the financial deadlock, a limitation of supplier credit, and major difficulties in economic chains. From this perspective, vigilance in relations with partners must be a top priority.” says Ovidiu Neacșu.

According to Sierra Quadrant, entrepreneurs must quickly understand that calling a restructuring specialist should be done at the first signs of temporary difficulty, not when the deterioration has become chronic and fatal.

Only by intervening in time will they be able to credibly demonstrate to a judge that their business still has a future and is worth saving.

Will 2026 bring a collapse for small and medium-sized businesses?

The figures don't offer much reason for optimism. An analysis recently launched by Sierra Quadrant showed that in the first quarter alone, over 1,600 Romanian companies became insolvent. They left behind colossal debts of almost 2.74 billion lei, affecting the jobs of over 7,000 employees.

According to experts, the real survival test for a company is not issuing the invoice, but collecting the money.

In an increasingly volatile economic environment, the vulnerability of Romanian businesses is dangerously building at the intersection of three major factors. These are the growing dependence on logistics and energy costs, ever-extending payment collection deadlines, and profit margins too thin to absorb price shocks. When these elements overlap, credit risk explodes, pushing companies to the brink of collapse.

With over 27 years of experience in the Romanian business environment, Sierra Quadrant is one of the most important companies specializing in complex administration and liquidation works, with a high degree of difficulty, characterized by large and diversified assets, by the multitude of legal problems that need to be resolved simultaneously with the insolvency procedure: environmental assessments, hazardous substances on property, unclear easements, and asset-related litigation, the analyst concluded.
